My friend had an accident this Thursday. He lost control of his car and hit a guard rail. His car got totaled. He was very shaken up and called his family. His family memeber came and picked him up. He states he was in shock. He called the insurance company and reported the accident. They advised him he needed to go back to the accident and speak to the cops.. He did go back to the scene. The cops initially arrested him. But after speaking to him and because he was very cooperative they gave him a ticket of leaving the scene instead of taking him to jail. He does not have any priors arrest or charges. Could he face jail time for this incident? Or would he more likely face fines, maybe probation or even the possibility of losing his licensce? Any advice would be greatly appreciated. He is very worried.

Your friend is facing a misdemeanor, which carries a fine of up to $1,000 dollars and up to one year in jail. However, it is unlikely he will receive any jail time since this is a 1st offense. His case (in the eyes of a prosecutor)improved dramatically since he voluntarily returned to the scene of the accident….For more on defense strategy, call my office (404 522-1000) and ask for Attorney Mary Beth Wood.
